This Privacy Policy explains how Torch Workspace, LLC ("Torch," "we," "us") collects, uses, discloses, and protects information in connection with torchworkspace.com and app.torchworkspace.com (the "Sites") and our website-management and membership-platform services (the "Services").

By using the Sites or Services, you agree to this Policy.

1. Who this Policy covers

This Policy describes information we handle as a business, about our own customers and prospects.

It also explains, in Section 3, how we handle information on behalf of our customers - the membership organizations who use our platform. Where we process information belonging to a customer's members, that customer determines how the information is used and this Policy is not the governing notice. Members should refer to their own organization's privacy policy.

2. Information we collect about you

Information you provide

  • Contact details submitted through inquiry, demo, or signup forms - name, email, phone number, organization, role, and message content.
  • Account and billing information for organizations that engage our Services. Payment card details are handled by our payment processor; we do not store full card numbers.
  • Content, brand assets, and credentials you provide so that we can deliver the Services, governed by the confidentiality terms of our Master Services Agreement.
  • Support communications you send us.

Information collected automatically

  • Usage and device data - IP address, browser type, pages viewed, referring source - collected through cookies and analytics. See Section 7.
  • Email engagement data such as opens and clicks, where you have received email from us.

Information from other sources

  • Publicly available business information about organizations and their officers, used to identify organizations that may benefit from our Services. This includes names, roles, organizational affiliation, and business contact details drawn from public directories and organization websites.

3. Information we process on behalf of our customers

This is the most significant category of information we handle, and we describe it separately because our role is different.

Our customers are membership organizations. Our platform holds information about their members, including names, email addresses, phone numbers, membership status and standing, officer roles and terms, event participation, and dues and payment records.

We act as a service provider. The organization determines what information is collected and how it is used. We process it only to provide the Services, under their instruction and under the terms of our agreement with them. Specifically:

  • We do not sell member information.
  • We do not use member information for our own marketing.
  • We do not use member information to train machine-learning models.
  • We do not disclose member information to any party other than the service providers listed in Section 5, and only as necessary to deliver the Services.

Members who wish to access, correct, or delete their information should contact their organization, which controls it. We will assist the organization in responding.

When a customer relationship ends, we retain their data for 90 days to allow for export and reinstatement, then delete it, unless a longer period is required by law or agreed in writing.

4. How we use information

  • To respond to inquiries and to provide, maintain, and improve the Services.
  • To send service-related and transactional communications, including account notifications, security alerts, and support responses.
  • To send marketing communications where permitted, from which you may opt out at any time.
  • For analytics and to understand how the Sites and Services are used.
  • To bill for the Services and maintain financial records.
  • To comply with legal obligations and enforce our agreements.

5. How we share information

We do not sell personal information.

We share information with service providers who process it on our behalf under confidentiality obligations, and only as necessary to deliver the Services:

Torch Workspace, LLC is a product of PlunkOps, LLC, which operates the shared communications infrastructure used to deliver notifications relating to the Services. See plunkops.com/privacy-policy.

We also share information as required by law or legal process, to protect rights and safety, and in connection with a merger, acquisition, or sale of assets, subject to this Policy.

We engage contractors located outside the United States who may access information in the course of delivering the Services, under confidentiality obligations.

6. Email and text message communications

Email. Marketing emails comply with the CAN-SPAM Act and include an unsubscribe mechanism. Transactional messages related to active Services may continue regardless of marketing preferences.

Text messages. Account and service notifications relating to the Services are sent by PlunkOps, LLC, which operates our communications infrastructure. We send text messages only to individuals who have provided prior express consent.

  • What we send: account and security notifications, onboarding and setup reminders, support responses, and service status alerts.
  • Frequency: message frequency varies.
  • Cost: message and data rates may apply.
  • To opt out: reply STOP to any message. You will receive one confirmation and no further messages.
  • For help: reply HELP, or contact support@torchworkspace.com.

Consent to receive text messages is not a condition of purchasing any product or service. We do not sell or share mobile numbers or text-message consent with third parties for their own marketing purposes.

Messages sent by customer organizations. Where an organization uses our platform to send messages to its own members, that organization is responsible for obtaining and maintaining prior express consent from each recipient and for honoring opt-out requests.

7. Cookies and analytics

The Sites use cookies and similar technologies, including Google Analytics 4, to understand usage and improve performance. You can control cookies through your browser settings and, where a consent banner is presented, through your consent choices. Disabling cookies may affect Site functionality.

8. Data retention and security

We retain personal information only as long as necessary for the purposes described or as required by law, then delete or de-identify it. Customer data retention is described in Section 3. We use commercially reasonable administrative, technical, and physical safeguards to protect information, including encryption in transit, access controls, and credential management. No method of transmission or storage is completely secure.

9. Your privacy rights

Depending on your state of residence you may have rights to access, correct, delete, or obtain a copy of your personal information, and to opt out of certain processing. This includes residents covered by the California Consumer Privacy Act as amended, and comparable laws in Virginia, Colorado, Connecticut, and other states.

California residents have the right to know, delete, and correct personal information, to opt out of its sale or sharing - we do not sell or share personal information - and not to be discriminated against for exercising these rights.

To exercise any right, contact us using Section 11. We will verify your request and respond within the timeframe required by applicable law.

If your request concerns information held on behalf of a membership organization, see Section 3.

10. Children's privacy

The Sites and Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided information, contact us and we will delete it.

Customer organizations that operate scholarship or youth programs are responsible for their own compliance with the Children's Online Privacy Protection Act in connection with those programs.
